9.5 Under no circumstances may these terms exclude or limit mandatory rights granted to consumers under applicable laws.
-
PRODUCTS MARKETED
10.1 FOPPA markets sunglasses, optical frames, accessories, and other items from the eyewear sector through its website.
10.2 Essential product characteristics are illustrated on the respective product pages, which serve as reference for selection and purchase.
10.3 FOPPA guarantees the authenticity of products sold. Items are original and sourced through legitimate commercial supply channels.
10.4 Products are shipped with the case, accessories, and packaging provided by the respective manufacturer for that specific item. Certificates of authenticity, if applicable or available, are provided.
10.5 Product images published on the site are for illustrative purposes and are produced or selected to represent the items sold as accurately as possible.
10.6 Non-substantial differences in color and finish perception may occur due to display settings on the devices used.
10.7 Purely visual differences attributable to screen rendering do not automatically constitute a lack of conformity, without prejudice to the necessary correspondence of the product to contractually declared characteristics and legal conformity requirements.
10.8 Should an item possess special characteristics or require specific usage precautions, such information will be stated on the product page, manufacturer documentation, or packaging.
10.9 The Customer is invited to carefully read the instructions and warnings provided by the manufacturer before using the purchased product.
10.10 For products equipped with electronic, digital, or connected features, additional instructions, technical requirements, digital service terms, and notices from the respective manufacturer may apply. Such documents do not limit the legal guarantee owed by FOPPA as Seller.
10.11 Optical frames sold without prescription ophthalmic lenses are not to be considered, per se, complete corrective products. Any fitting of prescription lenses must be performed by qualified professionals, in compliance with applicable prescriptions and guidelines.
-
PRODUCT AVAILABILITY
11.1 Product availability is indicated on the respective product pages and other relevant sections of the site.
11.2 Some products may be stocked in the e-commerce warehouse, while others may be available at one of the FOPPA or OOF retail stores.
11.3 When a product needs to be transferred from a retail store to the e-commerce warehouse, order processing times may be longer than for items already present in the shipping warehouse.
11.4 Availability displayed on the site is subject to updates and may vary due to simultaneous purchases, inventory differences, or other operational circumstances.
11.5 If one or more products become unavailable after order placement, FOPPA will inform the Customer promptly, proposing an alternative solution where possible.
11.6 The Customer is not required to accept substitute products or unilateral order modifications.
11.7 If the ordered product cannot be supplied and no alternative solution is agreed upon, FOPPA will refund any amounts already paid for the unfulfilled products without undue delay and in compliance with applicable law.
11.8 Any automatic substitution of the product with items of different brand, model, color, or characteristics without the Customer's consent is excluded.
-
PURCHASE PROCEDURE AND CONCLUSION OF CONTRACT
12.1 To make a purchase, the Customer selects desired products and adds them to the virtual shopping cart.
12.2 Before submitting the order, the Customer can check cart contents, quantities, prices, applied discounts, and shipping fees.
12.3 During checkout, the Customer enters or confirms requested billing, payment, and delivery information.
12.4 Prior to final order submission, the site presents a summary of essential purchase details, including total price and any applicable additional costs.
12.5 The Customer has the opportunity to review entered data and correct any errors before completing the purchase.
12.6 Order submission occurs via a command clearly identifying the obligation to pay, pursuant to Article 51 of the Consumer Code.
12.7 By placing the order, the Customer makes a purchase offer for the selected products under the conditions stated in the summary and in these General Terms of Sale.
12.8 Upon receipt of the order, FOPPA sends an electronic communication containing the purchase summary and relevant information.
12.9 The sales contract is deemed concluded when FOPPA communicates order acceptance to the Customer via electronic confirmation. A simple automated receipt notification, where explicitly qualified as such, does not constitute acceptance of the purchase offer.
12.10 FOPPA may decline an order for justified reasons, such as product unavailability, unauthorized payment, incomplete essential information, reasonable suspicion of fraud, or violations of applicable law.
12.11 In case of non-acceptance, the Customer will be informed, and any charged amounts will be refunded without undue delay.
12.12 Applicable financial terms are those communicated to the Customer before order submission and confirmed upon contract conclusion.
12.13 The Customer is advised to retain the order confirmation and purchase-related communications.
12.14 FOPPA retains order information in compliance with applicable tax, accounting, contractual obligations, and data protection rules.
-
PURCHASE REQUIREMENTS
13.1 The Customer placing an order must possess the legal capacity required by law to validly enter into the contract.
13.2 Purchases made on behalf of minors must be completed by a parent, legal guardian, or other legally authorized party.
13.3 The Customer guarantees that information provided for the purchase is accurate and that the payment method used is employed lawfully.
13.4 Products must be used in accordance with their intended purpose and manufacturer instructions.
13.5 For products requiring specialized or professional evaluation prior to use, the Customer is invited to consult a competent professional.
-
PRICES, CURRENCIES, AND TAXES
14.1 Product prices are indicated on the site in the currency applicable to the selected country or market.
14.2 For purchases destined for Italy and other markets where tax-inclusive pricing is required, amounts include VAT applicable under current legislation.
14.3 For international shipments, tax treatment may vary according to the destination country and applicable regulations.
14.4 Prior to order completion, the total product price, taxes applied by the Seller, shipping costs, and additional pre-determinable charges payable by the Customer are indicated.
14.5 For shipments to non-EU countries or territories subject to special customs regimes, customs duties, import taxes, clearance fees, or other charges required by local authorities may apply.
14.6 Unless expressly stated otherwise during checkout, such import charges are not included in product prices or shipping fees and are the responsibility of the recipient.
14.7 The Customer is invited to verify any customs and tax obligations applicable in the destination country before completing the purchase.
14.8 If delivery is subject to customs, commercial, or regulatory restrictions, FOPPA may request additional information or decline the order if execution is prohibited or not practically feasible.
14.9 Any currency conversion fees or charges applied independently by the Customer's bank or payment service provider are governed by that intermediary's terms, without prejudice to mandatory rights provided by law.
-
PROMOTIONS AND PRICE REDUCTIONS
15.1 FOPPA may offer promotional offers, price reductions, and other commercial initiatives for limited periods or on specific products.
15.2 Promotions are subject to specific conditions stated on the site or in the relative commercial communication.
15.3 When announcing a price reduction subject to Article 17-bis of the Consumer Code, FOPPA displays the prior price in accordance with applicable rules.
15.4 Prior price means, where required by law, the lowest price applied to the general public of consumers during the thirty days preceding the application of the reduction.
15.5 Exceptions, including those regarding products marketed for less than thirty days, progressive reductions, and personalized promotions, are governed by applicable law.
15.6 FOPPA reserves the right to modify or terminate promotional initiatives for future purchases, without modifying the economic conditions of contracts already concluded.
-
DISCOUNT CODES
16.1 Discount codes can be used on products included in corresponding promotions, subject to the conditions and validity period specified for each initiative.
16.2 Unless indicated otherwise, discounts apply to individual eligible items in the cart rather than across the total order value indiscriminately.
16.3 To apply a discount code, the Customer must enter it into the designated field during checkout before finalizing the order.
16.4 The system automatically applies the discount to items meeting promotion criteria.
16.5 Discount codes are not valid on products from the following brands:
Jacques Marie Mage, Off-White, Kuboraum, T HENRI, DIOR, CELINE, GIVENCHY, LOEWE, FENDI, MOSCOT, Cartier, Maui Jim, John Dalia, Anna-Karin Karlsson, BlackFin, DITA, Matsuda, Thom Browne, CAZAL, Julius Tart, Ray-Ban META, and OAKLEY META.
16.6 The list of excluded brands may be updated over time. Applicable exclusions are those stated in promotion terms at the time of purchase.
16.7 Discount codes cannot be combined with each other or with other promo codes, unless expressly stated otherwise.
16.8 A single code cannot be applied multiple times to the same product unless initiative terms state otherwise.
16.9 If the cart contains products excluded from the promotion, those items will not receive the price reduction.
16.10 Discount codes cannot be converted into cash, unless required by law or specified by particular initiative terms.
16.11 In case of withdrawal or partial return, refunds for returned items are calculated based on the actual price paid after discount application.

-
PREPARATION AND DELIVERY TIMES
21.1 Product pages display an estimated delivery date calculated based on item availability and standard preparation and transport times.
21.2 Timescales may vary depending on whether the product is stocked in the e-commerce warehouse or transferred from a FOPPA or OOF retail store.
21.3 Estimated dates account for standard DHL transit times for the selected destination.
21.4 When an order contains multiple products with differing availability times, shipment is normally dispatched once all items are ready, unless otherwise communicated or agreed with the Customer.
21.5 In such cases, the overall estimated delivery date reflects the item requiring the longest preparation time.
21.6 Delivery dates indicated on the site represent operational estimates unless a deadline was explicitly agreed as essential or binding.
21.7 Deliveries may occur earlier or experience delays due to holidays, order volume peaks, warehouse transfers, weather conditions, customs inspections, or transport issues.
21.8 In any case, FOPPA undertakes to respect delivery obligations provided under applicable laws.
21.9 Unless a different deadline was agreed upon, the Seller must deliver goods to the Consumer without unjustified delay and within thirty days of contract conclusion, pursuant to Article 61 of the Consumer Code.
21.10 In case of non-delivery within the agreed or legal timeframe, the Consumer may call upon FOPPA to deliver within an additional period appropriate to the circumstances.
21.11 If delivery does not occur within this additional period, the Consumer may terminate the contract under conditions provided by law.
21.12 An additional period is not required in scenarios under Article 61 of the Consumer Code, including cases where the Seller explicitly refused delivery or adherence to an essential deadline was a determining factor of the contract.
21.13 Upon contract termination for non-delivery, FOPPA will refund due amounts in compliance with applicable law.
-
SHIPMENT TRACKING
22.1 Once product availability is confirmed, FOPPA sends the Customer a communication containing the DHL shipment tracking code.
22.2 For items sourced from retail stores, tracking codes may not be active immediately, as internal transfer to the e-commerce warehouse must be completed first.
22.3 When the order is handed over to DHL, the Customer receives a follow-up communication confirming dispatch and expected delivery date.
22.4 The Customer can monitor shipment progress via the official courier site:
22.5 Tracking information may take a few hours to update after carrier pickup.
22.6 The Customer is advised to check courier communications to facilitate correct order delivery.
-
DELIVERY METHOD AND TRANSFER OF RISK
23.1 Products are prepared and packed using packaging appropriate to their nature to ensure protection during transport.
23.2 The Customer is advised to carefully check the accuracy of the shipping address, door/intercom name, and telephone contact provided.
23.3 Delivery to an address different from the billing address can be requested during checkout.
23.4 Upon delivery, the Customer is invited to inspect the outer condition of the parcel.
23.5 In case of evident damage, tampering, or packaging anomalies, accepting the delivery with specific reservation (noting the issue) or refusing delivery while informing Customer Service immediately is recommended.
23.6 Failure to state a reservation upon delivery does not automatically forfeit statutory rights, including those under legal conformity guarantees.
23.7 In consumer contracts, risk of loss or damage to products transfers to the Consumer once they, or a designated third party other than the carrier, take physical possession of goods, pursuant to Article 63 of the Consumer Code.
23.8 If the Consumer independently chooses a carrier not suggested by the Seller, risk transfer is governed by specific provisions under Article 63 of the Consumer Code.
23.9 Alternative delivery instructions given directly by the Customer to the courier are evaluated according to applicable laws and specific circumstances. Automatic limitation of mandatory Consumer rights remains excluded.
-
FAILED DELIVERY AND INCORRECT INFORMATION
24.1 The Customer is responsible for the accuracy of information provided at checkout.
24.2 In case of incorrect address, recipient unavailability, or failure to respond to courier notifications, FOPPA and DHL may request further instructions to complete delivery.
24.3 Should a shipment be returned to sender due to circumstances attributable to the Customer, FOPPA may agree on a reshipment, notifying any additional costs beforehand.
24.4 Any charges requested from the Customer must be justified, proportionate, and directly related to handling the failed delivery, in compliance with applicable rules.
24.5 Consumer rights regarding withdrawal, contract termination, refunds, and legal guarantees remain unaffected.
-
INTERNATIONAL SHIPMENTS AND CUSTOMS PROCEDURES
25.1 Orders shipped to non-EU countries or territories under special customs regimes may require inspections, declarations, documents, and formalities specified by competent authorities.
25.2 The Customer must provide accurate information and reasonably cooperate when necessary for customs clearance formalities.
25.3 Unless stated otherwise at checkout, customs duties, import taxes, and clearance fees applied in the destination country are borne by the recipient.
25.4 Customs checks may cause variations in estimated delivery times.
25.5 FOPPA cannot guarantee timing for inspections conducted by customs authorities, but remains bound by legal obligations under applicable law.
25.6 International purchases must comply with export/import prohibitions, economic sanctions, and commercial restrictions.
25.7 FOPPA may refuse or cancel orders whose shipment would violate binding regulations.
-
ORDER CANCELLATION
26.1 The Customer may request order cancellation before it is processed for shipment.
26.2 Where available for the order, cancellation can be performed independently via the designated feature in the Customer Account.
26.3 Alternatively, the Customer can contact Customer Service at shop@foppa.it, stating the order number.
26.4 If the order has already been processed or handed to the carrier, operational cancellation of the shipment may no longer be possible.
26.5 In such event, the Consumer retains the right of withdrawal, where applicable, according to procedures outlined in the following sections.
26.6 If cancellation is confirmed prior to dispatch, FOPPA will refund collected amounts via original payment methods in accordance with applicable regulations.
-
RIGHT OF WITHDRAWAL
27.1 Consumers purchasing products on foppa.it have the right to withdraw from the sales contract within fourteen calendar days without providing any reason, pursuant to Articles 52 et seq. of the Consumer Code.
27.2 The fourteen-day period starts from the day on which the Consumer, or a designated third party other than the carrier, acquires physical possession of products.
27.3 For orders involving multiple products delivered separately, the period begins when the Consumer or third party acquires physical possession of the last product.
27.4 For products consisting of multiple lots or pieces, the period begins upon receipt of the last lot or piece as prescribed by law.
27.5 The withdrawal period includes Saturdays, Sundays, and public holidays. Expiry calculations follow statutory rules.
27.6 The right of withdrawal is reserved exclusively for consumers purchasing for purposes outside their trade, business, or profession.
27.7 The right of withdrawal provided by the Consumer Code does not apply to purchases made by companies or professionals in the exercise of their business activities, unless explicitly agreed otherwise.
-
EXERCISING THE RIGHT OF WITHDRAWAL
28.1 To exercise the right of withdrawal, the Consumer must inform FOPPA of their decision through an explicit statement.
28.2 Requests can be submitted via the Customer Account by selecting the order and using the online feature, when available.
28.3 Alternatively, the Consumer may send an email to:
28.4 The communication should include the order number, items being returned, and explicit statement of intent to withdraw.
28.5 Specifying a reason for withdrawal is not required.
28.6 Consumers can consult information regarding procedures for exercising withdrawal rights and return instructions on the Returns & Warranties page. The model withdrawal form under Article 49(1)(h) of the Consumer Code is made available to the Consumer, without obligation of use. Withdrawal may also be exercised via any other explicit statement in accordance with this article.
28.7 To meet the withdrawal deadline, sending the notice prior to the expiration of the fourteen-day period is sufficient.
28.8 FOPPA will confirm receipt of the request and provide instructions for return shipment where necessary.
28.9 Exercising withdrawal rights is not conditional upon exclusive use of the Customer Account or specific online functionality.
-
RETURN TERMS AND CONDITIONS
29.1 Following notice of withdrawal, the Consumer must return products without undue delay and in any case within fourteen calendar days from notifying their decision to withdraw.
29.2 The deadline is met if products are handed to the carrier or returned via accepted methods prior to period expiration.
29.3 Consumers may try on eyewear to inspect fit, characteristics, and functioning, to the extent necessary to evaluate items as they would in a physical store.
29.4 The Consumer is solely liable for any diminished value of products resulting from handling other than what is necessary to establish nature, characteristics, and functioning, pursuant to Article 57 of the Consumer Code.
29.5 Scratches, damage, or signs of wear exceeding normal inspection may result in a reduced refund proportional to actual diminished value, within legal limits.
29.6 Such circumstances do not automatically trigger forfeiture of withdrawal rights.
29.7 FOPPA evaluates diminished value case-by-case, considering actual product condition and Consumer rights.
29.8 Consumers are invited to return products clean and complete with received accessories (e.g., case, pouch, microfiber cloth, certificates, and extra items).
29.9 Absence of original packaging does not automatically invalidate withdrawal rights.
29.10 If original FOPPA packaging is unavailable, Consumers may use another suitable cardboard box ensuring adequate protection during transport.
29.11 Removing previous shipping labels from outer packaging prior to dispatch is recommended.
-
RETURN METHODS
30.1 Consumers returning items purchased on foppa.it may choose between shipping via a courier of their choice or dropping off items at a FOPPA or OOF retail store in Italy.
30.2 Returns must be completed within fourteen days of notifying withdrawal.
30.3 Chosen return methods must comply with operational terms of each service and statutory rights.
-
RETURNS VIA COURIER
31.1 The Consumer may ship products back using a carrier of their choice.
31.2 In case of discretionary withdrawal (change of mind), direct costs of return shipping are borne by the Consumer.
31.3 Products must be sent to the following address:

31.4 FOPPA recommends using a trackable shipping service and retaining shipping receipts until the refund process is complete.
31.5 Consumers must use proper packaging capable of protecting items in transit.
31.6 Returns originating from non-EU countries may require specific customs documentation.
31.7 Customs duties, taxes, or clearance fees related to returned merchandise are handled according to applicable rules and specific return terms.
31.8 For logistical and customs reasons, FOPPA advises returning items from the same country to which they were delivered.
31.9 If this is not possible, the Customer should contact Customer Service beforehand for guidance.
31.10 Returning items from a different country than destination does not, per se, invalidate mandatory Consumer rights.
-
RETURNS AT FOPPA AND OOF RETAIL STORES
32.1 FOPPA allows Customers to return items bought online via direct drop-off at a FOPPA or OOF retail location in Italy.
32.2 In-store returns must occur within fourteen calendar days of withdrawal notification.
32.3 The item is received by store staff and processed internally for verification and refund.
32.4 Currently, FOPPA and OOF retail stores do not issue immediate cash/card refunds for online orders.
32.5 Stores also do not process immediate exchanges for items purchased via the website.
32.6 Refunds are processed subsequently according to methods and timelines outlined in these terms and applicable laws.
32.7 Dropping off products in-store does not constitute immediate completion of administrative refund procedures.
32.8 FOPPA reserves the right to update in-store return handling procedures over time.
-
REFUNDS UPON WITHDRAWAL
33.1 Upon valid exercise of withdrawal, FOPPA refunds payments received from the Consumer for the contract, including initial standard delivery fees where required by law.
33.2 Refunds are processed without undue delay and within fourteen days from the day FOPPA is informed of the decision to withdraw.
33.3 Under Article 56 of the Consumer Code, FOPPA may withhold refunds until goods are received back or proof of return shipment is provided, whichever is earlier.
33.4 Refunds use the same payment method as the initial transaction, unless explicitly agreed otherwise and provided no extra costs are incurred by the Consumer.
33.5 For full order withdrawals, refunds include initial delivery charges up to the cost of the cheapest standard delivery offered by FOPPA.
33.6 If the Consumer selected a shipping method costlier than the standard option, FOPPA is not required to refund supplementary costs resulting from that choice.
33.7 For partial withdrawals, original delivery fees are generally non-refundable if those fees would have been incurred for remaining unreturned items, subject to mandatory law.
33.8 Reductions in refund amounts due to diminished product value apply exclusively under statutory limits.
33.9 Refunds are issued in the currency of the original transaction.
33.10 Differences from exchange rates or independent bank fees fall under third-party service terms, without prejudice to Consumer rights.
33.11 Credit timing depends on banking networks/payment providers and may require additional business days following issue.
33.12 For card payments, reflection on statements typically takes 5 to 10 business days depending on the issuing institution.
33.13 FOPPA charges no fees for processing refunds resulting from exercised withdrawal rights.
-
EXCLUSIONS FROM RIGHT OF WITHDRAWAL
34.1 The right of withdrawal is subject to statutory exceptions under Article 59 of the Consumer Code and other mandatory laws.
34.2 Legal exceptions include, where applicable, supply of custom-made or clearly personalized goods based on Consumer specifications.
34.3 Selecting standard product variants (brand, model, color) does not exclude withdrawal rights.
34.4 If FOPPA sells genuinely personalized products covered by statutory exclusions, withdrawal exclusion will be communicated clearly before purchase completion.
34.5 Additional exceptions apply only when all statutory conditions under current law are met.
34.6 Exceptions to withdrawal rights do not affect legal guarantees of conformity or other statutory rights.
-
REPLACEMENTS AND PRODUCT EXCHANGES
35.1 FOPPA currently does not process direct product exchanges for personal preference.
35.2 Customers wishing to obtain a different model, color, or product should return the received item via the withdrawal procedure (where applicable) and place a new order.
35.3 Subsequent purchases constitute separate transactions from previous sales contracts.
35.4 Pricing applicable to new orders corresponds to rates active at the time of completion.
35.5 Consumer rights to repair, replacement, price reduction, or contract termination under legal conformity warranties remain fully unaffected.
-
LEGAL WARRANTY OF CONFORMITY
36.1 All new products purchased by consumers on foppa.it are covered by the legal warranty of conformity under Articles 128 et seq. of the Consumer Code.
36.2 FOPPA, as Seller, is liable to the Consumer for conformity defects existing at delivery that manifest within two years, according to applicable rules.
36.3 The legal warranty protects Consumers if products fail to conform to the sales contract or statutory subjective/objective conformity requirements.
36.4 A defect of conformity exists, for instance, if the product does not match description, type, quantity, or quality agreed, or lacks features reasonably expected by law.
36.5 Conformity is evaluated taking into account product nature, stated specs, samples/models presented, instructions, and relevant circumstances.
36.6 Legal warranty remedies can be asserted against FOPPA as Seller, independently of manufacturer commercial warranties.
-
REMEDIES UNDER LEGAL WARRANTY
37.1 In the presence of a conformity defect, the Consumer has the right to have conformity restored via repair or replacement free of charge, subject to statutory conditions.
37.2 The Consumer may choose between repair and replacement, unless the chosen remedy is impossible or imposes disproportionate costs on the Seller compared to the alternative option, under the Consumer Code.
37.3 Repair or replacement will be completed within a reasonable timeframe after FOPPA is notified, without significant inconvenience to the Consumer, taking into account item nature and intended purpose.
37.4 Where legal conditions are met, the Consumer may request a proportional price reduction or contract termination.
37.5 These remedies apply, inter alia, if repair/replacement is impossible, was not properly completed, or under conditions outlined in Article 135-bis of the Consumer Code.
37.6 Contract termination is not permitted if the conformity defect is minor, within statutory limits.
37.7 In case of termination for non-conformity, item returns and refunds are handled pursuant to Consumer Code provisions.
37.8 Expenses required to implement legal warranty remedies (shipping, transport, labor, materials) are borne by FOPPA within legal bounds.
-
WARRANTY ASSISTANCE PROCEDURE
38.1 Consumers noticing a potential conformity defect can contact Customer Service at:
38.2 To facilitate requests, providing the order number and a description of the issue is recommended.
38.3 FOPPA may request photos or additional information reasonably necessary to verify reported defects.
38.4 When technical verification is required, FOPPA communicates return logistics to the Consumer.
38.5 If covered under legal warranty, costs for return, inspection, and remedy application are borne by FOPPA according to law.
38.6 Consumers should use adequate packaging to protect items and include necessary components for testing.
38.7 Requests are evaluated considering item features, reported defects, and applicable legal rules.
38.8 Legal warranty rights cannot be excluded solely because original packaging is missing, provided defect verification and remedy application remain possible.
38.9 For defects manifesting within one year of delivery, the presumption of pre-existence at delivery applies, under Article 135 of the Consumer Code.
38.10 Legal burden-of-proof rules and special provisions pertinent to product nature remain applicable.
-
EXCLUSIONS AND LIMITATIONS OF LEGAL WARRANTY
39.1 The legal warranty does not cover all product deterioration, focusing specifically on statutory conformity defects.
39.2 Damage caused by accidents, impacts, drops, improper use, incorrect maintenance, or normal wear and tear does not constitute a conformity defect attributable to the Seller.
39.3 For example, scratches from ordinary use, accidental damage, deformation from misuse, or chemical damage may fall outside warranty coverage based on specific circumstances.
39.4 Third-party repairs or modifications do not automatically invalidate warranty rights but are relevant if they directly caused the claimed defect.
39.5 Coverage evaluations are conducted case-by-case without derogating from statutory consumer rights.
39.6 Provisions herein do not limit Consumer rights where damage stems from an original conformity defect.
-
MANUFACTURER COMMERCIAL WARRANTIES
40.1 Some products may carry additional commercial warranties offered by their manufacturers.
40.2 Such warranties are governed by terms issued by the warrantor and may define specific duration, coverage, and assistance terms.
40.3 Commercial warranties are supplementary and do not replace the legal conformity warranty owed by FOPPA.
40.4 Consumers retain statutory rights against the Seller under the Consumer Code at all times.
40.5 Manufacturer commercial warranties cannot limit, suspend, or condition the exercise of legal warranty remedies.
-
PURCHASES BY PROFESSIONALS AND BUSINESSES
41.1 Purchases made in the exercise of trade, business, craft, or professional activities are not subject to the special consumer legal warranty rules under the Consumer Code.
41.2 Civil Code provisions and relevant rules apply to business purchases, including statutory rules on defects, notice periods, and limitation periods.
41.3 Mandatory legal provisions and express contractual agreements between parties remain unaffected.

42.5 Notifications are handled in compliance with legal conformity warranty terms and applicable law.
42.6 Failure to report damage immediately does not automatically forfeit statutory Consumer rights.
42.7 For incorrect or defective items covered under legal warranty, costs incurred to implement statutory remedies are borne by FOPPA.
-
LIMITATION OF LIABILITY
43.1 FOPPA is liable for performing contractual obligations under sales agreements within statutory limits.
43.2 FOPPA cannot be held liable for unforeseeable and unavoidable events constituting force majeure or subsequent impossibility of performance under legal conditions.
43.3 Force majeure events do not affect Customer rights to refunds, contract termination, or other legal remedies under applicable law.
43.4 FOPPA is not liable for damage resulting solely from product use non-compliant with intended purpose, instructions, or warnings, provided such damage is not attributable to Seller fault.
43.5 Nothing in these terms excludes or limits liability for willful misconduct, gross negligence, personal injury, or liability that cannot be excluded under law.
43.6 Provisions on defective product liability, legal conformity guarantees, and consumer protection remain unaffected.
-
